JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 30-01-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor as well as learned counsel for the informant.

Informant, who is not an eye witness, had received information regarding commission of murder of deceased Niraj Kumar @ Chhotu, his son whereupon he shown suspicion against Mahendra Prasad Sinha, Pankaj Kumar Sinha, Deepak Kumar, Kailash Prasad, Sujeet Kumar (petitioner). It is apparent that accused, Mahendra Prasad Sinha happens to be own brother of informant, Surendra Prasad Sinha and further, there happens to be specific disclosure that daughter of Mahendra Prasad Sinha and the deceased were love birds, which was not liked by them and accordingly, suspicion has been shown against them to have

Patna High Court Cr.Misc. No.53448 of 2015 (03) dt.30-01-2016 eliminated the deceased so that their love story could not flash as, Jyoti had already been married and was residing at her sasural. From perusal of the case diary, it is evident that although charge sheet had already been submitted against the petitioner, but without any cogent and reliable evidence. Furthermore, petitioner happens to be under custody since 05.07.2015.

Accordingly, petitioner, Sujeet Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Daudnagar P. S. Case no.21 of 2015.
