JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was all along on bail but when he was directed to appear before the court below for recording his statement under section 313 of the Cr. P. C, he failed to appear before the concerned court resulting cancellation of his bail vide order dated 27.03.01. Subsequently, petitioner could be remanded in this case on 29.07.2015 and since then he is in jail custody. Considering the conduct of the petitioner, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in Complaint Case no.176 C of 1996 pending in the

Patna High Court Cr.Misc. No.54124 of 2015 (2) dt.02-12-2015 2/2 court of Chief Judicial Magistrate, Munger stands rejected. However, it is made clear that the concerned trial court must dispose of the Complaint Case no.176 C of 1996 within a month from the date of receipt/ production of copy of this order, failing which the trial court shall release the petitioner on bail fixing the amounts of bail bonds on its own level.
