It appears from Annexure- E to the Supplementary Show-cause filed by the State that so far as petitioner Nos. 1 and 3 are concerned, the decision to the benefit, in compliance of the order has already been made. In so far as it relates to petitioner No. 2, the authorities have indicated that the decision to appoint him has been taken, but in view of the fact that the petitioner has already attained 41 years of age, whereas the maximum age limit has been fixed is 40 years in the case of B.C./E.B.C. category. The Committee has written to the Divisional Commissioner to consider his case for relaxation of age for which an appropriate request has been sent by the Department.

In view of the fact that due consideration of the petitioner's case has been made and even with regard to petitioner

Patna High Court MJC No.161 of 2017 (6) dt.17-04-2018 2/2 No. 2 there has been a positive consideration of his case, no further case of contempt is made out.

The contempt application stands disposed of with liberty to the petitioner to assail any order if at all passed to his detriment.

It is expected that the authority shall take final decision in matter of petitioner No. 2 within a period of four weeks from today.
