Let the defects, as pointed out by the office, be removed within four weeks of start of normal functioning of the physical court.

Petitioner seeks bail in connection with Bajpatti P.S. Case No. 401 of 2020 registered for the offences punishable under Sections 25(1-b)a, 26, 35 of the Arms Act. According to prosecution case, on 29.10.2020 the informant along with other police officials during patrolling duty intercepted two motorcycles. Seeing the police party, motorcycle rider started fleeing but with the help of police party two persons apprehended including the petitioner. On search, one loaded country made pistol and one mobile was recovered

Patna High Court CR. MISC. No.19794 of 2021(2) dt.15-11-2021 2/2 from possession of the petitioner.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner has been falsely implicated in the present case due to enmity. Learned counsel further submits that petitioner is in custody since 31.10.2020.

The learned Additional Public Prosecutor vehemently opposed the prayer of bail on the ground that he has got criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Pupri, Sitamarhi in connection with Bajpatti P.S. Case No. 401 of 2020.
