The petitioner seeks bail in Mohania P.S. Case No. 144 of 2013 dated 13.05.2013 instituted under Sections 326/307/34 of the Indian Penal Code.

This is the second attempt of the petitioner for bail as earlier such prayer was rejected by order dated 08.07.2014 in Cr. Misc. No. 311 of 2014.

Pursuant to two reports being called for, it appears that majority of the persecution witnesses have been examined and warrant had been issued for production of the rest. The second report is of April, 2016.

Patna High Court Cr.Misc. No.13996 of 2015 dt.04-07-2016 2/2 In view of the aforesaid, the Court is not inclined to consider the prayer for bail which is, accordingly, rejected. However, the Court below shall ensure that the remaining prosecution witnesses are examined latest within six weeks from today for which all necessary steps under law shall be taken. The Superintendent of Police, Kaimur at Bhabua is also directed to ensure that the remaining witnesses are produced before the Court on the dates fixed for such purpose.

The order be communicated to the Court below as well as Superintendent of Police, Kaimur at Bhabua by Fax also latest by tomorrow for its strict compliance.
