Petitioners seek bail in Bajpatti P.S. Case No.218 of 2016 registered under Sections 147, 149, 341, 323, 324, 354, 379, 504 and 506 of the IPC.

The prayer for anticipatory bail of petitioner no.1 was allowed vide order passed in Cr.Misc.No.35145 of 2019 but Ram Pujan Mandal (petitioner no.1) could not surrender in time and when he surrendered, he was also taken into custody along with Ramji Mandal (petitioner no.2) and their bail petition was rejected.

The informant alleged that all the accused persons came and assaulted the informant and others. Biltu Mandal is

Patna High Court CR. MISC. No.9639 of 2020(3) dt.02-06-2020 2/2 alleged to have inflicted knife blow on his head. Ramji Mandal (petitioner no.2) and Ram Pujan Mandal (petitioner no.1) are alleged to have given iron blow causing injury on the head of the informant.

Learned counsel for the petitioners submits that all other accused persons have already been enlarged on bail. The injuries are simple in nature.

Learned A.P.P., however, opposed the prayer for bail. Having considered the facts and the nature of allegations made against the petitioners and the fact that the petitioners are in jail since 02.01.2020, the petitioners named above are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(rupees ten thousand) each with two sureties of like amount each to the satisfaction of learned S.D.J.M., Pupri, Sitamarhi in connection with Bajpatti P.S. Case No.218 of 2016.
