The petitioners have filed this Civil Miscellaneous petition only for a direction to Sub-Judge-I, Katihar to dispose of the Misc. Case No.06 of 2018 filed under Order 21 Rule 100 of the C.P.C., which is pending in the Court of Sub-Judge-I, Katihar. Learned counsel for the petitioners submits that Title (Partition) Suit No.22 of 1987 was filed by Raghuvir Ram and Raghunandan Ram, the father and uncle of the petitioners for partition of ancestral property including the homestead land and final decree was prepared on 21.03.1988 but the house falling in the share of the petitioners has also been demolished in execution
Patna High Court C.Misc. No.909 of 2018 (2) dt.13-07-2018 2/2 of final decree.
Having considered the submission of the petitioners, I dispose of this Civil Miscellaneous petition with a direction to the Sub-Judge-I, Katihar to dispose of Misc. Case No.06 of 2018 filed under Order 21 Rule 100 of the Code of Civil Procedure expeditiously preferably within six months.
Accordingly, this Civil Miscellaneous petition is disposed of.
