The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 324 and other sections of the Indian Penal Code.

As per the prosecution case, the six named accused persons including the petitioner herein are stated to have come variously armed. On the orders of this petitioner it is stated that the accused persons started to assault the informant and others. Thereafter, it is stated that the petitioner assaulted with a sharp cut weapon/chura causing injury on the informant. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. So far as the first injury report of the informant is concerned which has been brought on record as Annexure 4 to the petition, simple

No.22117 of 2021(2) dt.07-10-2021 2/2 injures were found to be caused by hard and blunt substance, however, as per the contents of the order rejecting the application for bail of the petitioner, his subsequent injury was found to be grievous in nature. The petitioner has remained in custody since 27.12.2020 and has no criminal antecedent. Charge sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 9 months, the Court directs the petitioner to be enlarged on bail in connection with Amdabad P.S. Case no. 199 of 2019 (G.R. no. 5246 of 2019) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar.
