JUSTICE RAKESH KUMAR ORAL ORDER 07-12-2015 Heard Smt. Indu Kumari Sinha, learned counsel for the petitioner and learned A.P.P.

The petitioner, who is in custody in connection with Bhagwanpur P.S. Case No. 192 of 2013 registered for the offence punishable under Section 302/34 of the Indian Penal Code, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that from perusal of the F.I.R. itself it is evident that there is no specific accusation. Only on the basis of circumstantial evidence the petitioner has been made accused. It has been argued that dead body was recovered from the house of the brother of the petitioner namely Pankaj Poddar. The brother of the informant (deceased) was having illicit relation with the wife of Pankaj

Patna High Court Cr.Misc. No.52274 of 2015 (2) dt.07-12-2015 2/2 Poddar. Even in the F.I.R. though it has been asserted that Pankaj Poddar had called the deceased, none had seen the occurrence. In this case two co- accused persons on similar accusation have already been granted bail.

In view of the facts and circumstances, let the petitioner Chandan Poddar be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Bhagwanpur P.S. Case No. 192 of 2013.
