KUMAR ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 26-03-2018 Seeking exception to an order passed by the learned Writ Court in CWJ C No. 759 of 2015 on 22.02.2017 this appeal has been filed under Clause 10 of the Letters Patent.
In the matter of appointment to the post in question based on a panel said to have been prepared of 209 persons for the appointment to the 4th Grade post in the year 2008-09. The Writ Court has refused to interfere into the matter in view of certain orders passed by a Division Bench of this Court in LPA No. 427 of 2013 wherein all vacancies in question of 4th Grade post in the district of Begusarai were directed to be held afresh in accordance to law as per the
Patna High Court LPA No.568 of 2017 dt.26-03-2018 2/2 recruitment rules. It has been held by the Division Bench that all persons placed in the past panels will not have any right to priority or preferential treatment on account of their placement in such panel. In view of this direction of the Division Bench the learned Writ Court has held that merely because the petitioner's name appearing in the panel earlier prepared, a mandamus cannot be issued for appointing him and considering the order of the Division Bench has refused to interfere into the matter. In doing so, the learned Writ Court has snot committed any error warranting reconsideration. The appeal stands dismissed.
