JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner has been made accused in complaint case bearing Complaint Case No. 2036 of 2010, which was filed on 1706-2010 in respect of an offence, which is said to have been taken on 13-06-2010.

The accusation against petitioner is that he, having entered the house of the complainant, committed rape on her. The contention on behalf of the petitioner is that the complainant and the petitioner were in love since long and as a matter of fact, the complainant had earlier eloped with petitioner sometime in the year, 2009 for which, father of the complainant lodged a criminal case but subsequently, due to intervention of well-wishers, the matter was settled and the petitioner as well as

It is further contended by him that petitioner was granted bail by the court below in the case, which had been lodged by father of the complainant but the husband of the complainant was not satisfied with the above-said development and he persuaded the complainant to file this false case against the petitioner.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with C.A. Case No. 2036 of 2010 to the satisfaction of Sri R. K. Sinha, J.M.-Ist Class, Purnea.
