JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-02-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Kishanganj P.S. Case No. 580 of 2019 for the offenses under Section 379 of the Indian Penal Code.

Allegation against the petitioner is that he was involved in theft of motorcycle.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner is in custody since 7.12.2019. nothing was recovered from the conscious possession of the petitioner.

Learned counsel further submits that the petitioner was not named in the FIR still he has not been put on TIP. Considering the fact that the petitioner has no

Case No. 580 of 2019.
