The petitioner, Surendra Sahani, seeks regular bail in Kesariya P.S. Case No.125 of 2012, registered under Sections 307 and other sections of the Indian Penal Code and under Section 3/4 of the Explosive Substance Act.

Chandeshwar Choudhary, the informant, named eight persons and alleged that Krishna Sahani threw bomb, which hit his head, and Surendra Sahani, thereafter, threw one bomb, which hit on the hand of the informant.

Learned counsel for the petitioner submits that all the accused persons have already been granted bail. Even Krishna Sahani has been granted bail on 08.01.2015 vide order passed in Cr. Misc. No.31546 of 2014. Petitioner is in jail since 13.01.2014.

No.401 of 2015 (2) dt.09-01-2015 2/2 Considering the fact that the petitioner is alleged to have thrown bomb on the hand, but no injury was found on the hand of the informant. Krishana Choudhary, who is alleged to have thrown bomb on the head of the informant, has already been granted bail and the fact that the petitioner is in jail for last about one year, his prayer for bail is allowed.

The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, East Champaran at Motihari in connection with Kesariya P.S. Case No.125 of 2012.
