05.01.2015 Heard learned counsel for the Petitioner and the State.

The Petitioner seeks bail in Bakhtiyarpur P.S. Case No. 87 of 2013 (Sessions Case No. 153 of 2013/2010 of 2014) registered under Sections 399, 402 and 120B of the Indian Penal Code and 25(1-B)A, 26 and 35 of the Arms Act pending before the Ad hoc Additional Sessions Judge-II, Saharsa.

Considering that the Petitioner was found with arms while he was on bail in an earlier case instituted against him and, thus, evidently has misused the privilege of bail, I am not inclined to grant bail to him. The prayer for bail is rejected.

The Trial Court is directed to expedite the trial and for which reason he is directed to send a list of the

Patna High Court Cr.Misc. No.51668 of 2014 (2) dt.05-01-2015 witnesses fixing specific dates for production of the witnesses along with a copy of this order, to the Superintendent of Police, Saharsa, and the Superintendent of Police, Saharsa is directed to ensure production of the witnesses on the date so fixed by the Trial Court so that there is no further delay in trial.
