1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Trial no.2275 of 2023 (arising out of Ramnagar P.S. Case no.495 of 2022) registered under sections 379, 401, 413 and 34 of the Indian Penal Code.
3. As per the prosecution case, the informant states that having parked his motorcycle, the informant went inside for shopping. On return after 20 minutes, he found his motorcycle missing, the same having been stolen by unknown accused persons.
4. Learned counsel for the petitioner submits that the F.I.R. was registered against unknown. The name of the petitioner transpired in the confessional statement of co-accused Dilip Kumar in another case. No incriminating article has been
Patna High Court CR. MISC. No.13817 of 2024(2) dt.12-03-2024 2/2 recovered from the petitioner's possession. The reason for the petitioner's false implication is his antecedents. He is in custody since 5.9.2023 and undertakes to cooperate in the trial.
5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R., no incriminating article having been recovered from the petitioner's possession and the petitioner having remained in custody for 6 months since 5.9.2023, the Court directs the petitioner to be enlarged on bail in connection with Trial no.2275 of 2023 (arising out of Ramnagar P.S. Case no.495 of 2022) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bagaha, West Champaran on the following condition: (i) the petitioner shall remain physically present in Court on each date of the trial and shall cooperate in the trial. In case of the petitioner's absence on any single date for reasons not to the satisfaction of the learned trial Court, the learned trial Court may cancel the bail bond of the petitioner and take him into custody till conclusion of the trial.
