JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-05-2024 The present writ petition has been filed seeking the following relief:- "1.That, this writ petition is for issuance of an appropriate writ/ writs in nature of MANDAMUS for commanding and directing concerned authorities under District Administration especially the District Magistrate, Saran and Superintendent of Police equally to provide protection to his life, liberty and personal property, which are constitutional rights guaranteed under Article

Patna High Court CWJC No.2546 of 2024(2) dt.02-05-2024 2/2 21 and Article 300A of the Constitution of India considering the rights and entitlement upon the land in terms of the declaration of entitlement by the learned Civil Court with reference to Title Partition Suit No. 92 of 1990, which attains its finality. However, the Private Respondent has captured/ encroached upon piece of land with the help of unsocial elements or on point of muscle, man power and money ignoring declaration of title and possession upon land by learned Civil Court, whereas, such exercises are against established principle of law."

After some arguments, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the respondent no.3 i.e. the Superintendent of Police, Saran at Chapra for redressal of his aforesaid grievance. Liberty, so sought, is granted.

Accordingly, the writ petition stands disposed of.
