JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 Petitioner seeks regular bail in connection with Special (POCSO) Case No. 179 of 2019 (Marachi(Panchmahal Op) P.S. Case No. 17 of 2019) registered for the offence punishable under Section 366 (A) of the I.P.C. added Section 376 of the I.P.C. and Section 4 of the POCSO Act. Allegation against the petitioner is of kidnapping the daughter of the informant. However, learned counsel for the petitioner drawing the attention of the court towards Annexure2, statement of the victim girl was recorded under Section 164 Cr.P.C. said she is reside with him and married. It further appears that she is major aged about 18 years. Submission of the learned counsel for the petitioner is that they have solemnized marriage and leading peaceful conjugal life with each other. He is in custody for about three

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional District and Sessions Judge-I, Patna, in connection with Special (POCSO) Case No. 179 of 2019 (Marachi(Panchmahal Op) P.S. Case No. 17 of 2019) , subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
