The petitioner apprehends his arrest in Uchkagaon P.S. Case No. 380 of 2021, registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code.
As per the prosecution case, this petitioner inflicted Farsa blow on the head of informant causing head injury. It is submitted that both parties are Pattidars. As a matter of fact, the injured was in inebriated condition and he fell down on the bricks and sustained injuries. Thereafter, taking advantage of this situation, informant's side lodged this false and fabricated case. No motive has been assigned for the alleged occurrence. Petitioner is the sole earning member of the family and he is English Teacher in a renowned school, Gyanlok Public
Patna High Court CR. MISC. No.9697 of 2022(2) dt.04-08-2022 2/2 School, Gopalganj and due to this reason he has falsely been implicated in this case. Petitioner claims clean antecedent. Counsel for State however vehemently opposed the prayer for bail and submitted that there is specific allegation of causing Farsa blow on the head of informant, as a result of which informant sustained three injuries out of which two are grievous in nature.
Considering the facts aforesaid and nature of injury, I am not inclined to enlarge the petitioner above-named on anticipatory bail.
Accordingly, the prayer for bail is rejected. (Prabhat Kumar Singh, J) vinita/- U T
