Petitioner is not named in the first information report but in course of investigation, petitioner was arrested in Bhairabsthan P.S. Case no. 35/2014 in which he made confessional statement disclosing his involvement in the present case.

So far as recovery of pistol and footage of CCTV camera are concerned, the same does not relate to the petitioner and it is only stated that one magazine and 3 live cartridges were recovered from possession of the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate,
