The petitioners have preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016 As per allegation in the F.I.R., 171 litres of IMFL was recovered from a tempo in which both the petitioners were travelling.
It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in the case. They were merely passengers in the tempo and were unaware of the goods being carried therein. They have no
Patna High Court CR. MISC. No.19108 of 2021(2) dt.03-09-2021 2/2 concern with the seized liquor. They are in custody since 28.11.2020 and have no criminal antecedent. Investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioners not having any criminal antecedent, the Court directs the petitioners to be enlarged on bail in connection with C-1 case no. 211 of 2020 (CIS no.211 of 2020) on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Purnea.
