Petitioners seek regular bail in a case registered for the offence punishable under Section 420 and some other ancillary Sections of the Indian Penal Code and under Section 30 (a), 32, 41(i) of the Bihar Prohibition & Excise Act. . As per the prosecution case, 202 liters of Nepali liquor has been recovered from beneath the bundle of paddy. Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. No incriminating article has been recovered from the conscious possession of the petitioners and they are no way

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioners, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Court No.2, East Champaran, Motihari in connection with Adapur PS case No. 344/2021.
