The petitioner is apprehending his arrest in a case registered under Sections 414, 467, 468/34 of the Indian Penal Code and 30A of the Bihar Prohibition and Excise Act, 2016. The prosecution case, in short, is that police raided house of co-accused Niranjan Singh and recovered wine pouch, preparing apparatus like pouch punching machine, empty pouch, plastic drum etc. wife of said co-accused Niranjan Singh who was present at the house took the name of the petitioner as associate of her husband engaged in preparing wine. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no recovery from the conscious possession of the petitioner.
