The petitioner is apprehending his arrest in connection with Mejorgonj P.S. Case No. 463 of 2018, registered for the offences punishable under Sections 272/273 of the Indian Penal Code and Section 30 (a) of Bihar Prohibition and Excise Act, 2016.

Irrespective of the fact that there is no direct evidence against the petitioner, I am not inclined to grant anticipatory bail to the petitioner as the petitioner has got criminal antecedent of identical nature as disclosed in para-3 of the bail petition. Hence, the prayer for anticipatory bail is refused. However, in the event of surrender of the petitioner,

Patna High Court Cr.Misc. No.11256 of 2019(2) dt.25-02-2019 2/2 the prayer for regular bail shall be disposed of without being prejudiced by the order of this Court.
