JUSTICE PRABHAT KUMAR JHA ORAL ORDER 22-06-2016 Heard Sri Vikash Kumar Sharma, the learned counsel for the petitioner and the learned Additional Public Prosecutor. The petitioner has filed this petition for cancellation of anticipatory bail granted to Ganga Sagar Yadav, opposite party No. 1.
It is submitted that in the order sheet it has been typed that "admittedly, the petitioner borrowed money from the complainant and the same was to be adjusted" but it should have been typed that petitioner borrowed money from the complainant and promised to adjust that amount but the same was not adjusted and that is why the complaint case was filed in which Ganga Sagar
Patna High Court Cr.Misc. No.2549 of 2016 (2) dt.22-06-2016 2/2 Yadav was granted anticipatory bail.
In my view, there is no ambiguity in the order as the amount promised to be adjusted was not adjusted. I do not find ay reason for cancellation of bail granted to opposite party No.1. With the aforesaid observation, this petition is disposed of.
