Mr. Awadhesh Kumar Pandey, learned counsel for the Union of India is appearing.
Petitioner seeks bail in a case registered for the offences punishable under Sections 8 and 20(b)(ii) (c),23(c),25,27A,29 of the N.D.P.S.Act.
Petitioner is cleaner of the truck from which commercial quantity of Ganja was recovered. Petitioner is in custody since 17.06.2017. Co-accused-Santosh Kumar Patel @ Santosh Kumar was allowed bail by this Court in Cr. Misc.
Patna High Court CR. MISC. No.16485 of 2020(2) dt.10-07-2020 2/2 No.34253 of 2019 on 08.01.2020 on his second attempt for bail considering the fact that trial was not likely to be concluded. Now due to lock-down, the trial is not likely to be concluded, hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with N.D.P.S. Case No.13 of 2017 (N.C.B. Crime No.12 of 2017) with following conditions:
(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
