JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-02-2019 The petitioner seeks bail in anticipation of his arrest in connection with Triveniganj P.S. Case No. 35 of 2017, dated 11.02.2017, instituted for the offences under Sections 419, 420, 467, 468, 471, 464, 279, 120B and 34 of the Indian Penal Code and Section 27(a) of the Drugs and Cosmetics Act.

The First Information Report, which has been lodged, discloses offence under Bihar Clinical Establishment (Control and Regulation) Act, 2007.

The learned counsel for the petitioner has submitted that he is only a Sweeper in one of the unregistered medical clinics. It has also been submitted that

Patna High Court Cr.Misc. No.9125 of 2019(2) dt.15-02-2019 2/2 several other persons, who have been made accused in this case, have been granted anticipatory bail by different Benches of this Court, which have been annexed as Annexure-2 series to this application.

Considering the nature of accusation against the petitioner and the fact that other persons having greater responsibility and commitment have been granted anticipatory bail, the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Triveniganj P.S. Case No. 35 of 2017, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
