Petitioner is named neither in the first information report nor in the statement of victim but in course of investigation, one co-accused, Guddu Yadav was arrested and made his confessional statement naming the petitioner and one Jago Yadav as his associates. Co-accused Jago Yadav has already been granted privilege of bail by learned Additional Sessions Judge itself but the prayer for bail of the petitioner was rejected by the court below. Moreover, petitioner is in jail custody since 22-09-2015 and he does not have any criminal antecedent.
