JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 Petitioner seeks regular bail in connection with Belhar P.S. Case No. 336 of 2019 registered for the offence punishable under Section 398 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act. Petitioner is not named in the F.I.R., it appears that on the information supplied by co-accused and others, he has been arrested from a shop. Case is of the Bank Dacoity. Submission of the learned counsel for the petitioner is that he has not been arrested from the place of occurrence and nothing has been recovered from his possession. He was arrested only on suspicion. He is in custody since 31.10.2019. Charge-sheet has already been submitted.

Having heard both sides, in view of the facts and

No.8137 of 2020(2) dt.20-02-2020 2/2 circumstances, as stated above, the matter is disposed of with a direction to the learned Court below that trial has not been conducted in which case and petitioner has not been put on T.I.P. let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of C.J.M., Banka, in connection with Belhar P.S. Case No. 336 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with further condition that if the TIP has been done order has no effect.
