JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 29-04-2023 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner has preferred this application for grant of regular bail in connection with Lakhisarai (Kabaiya) P.S. Case No. 619 of 2022 dated 25.07.2022 registered for the offences punishable under sections 341, 323, 326, 307, 354A read with section 34 and later on added section 302 of the Indian Penal Code.

As per the prosecution case, the petitioner and the coaccused persons in connivance with one another holding

Patna High Court CR. MISC. No.9073 of 2023(2) dt.29-04-2023 2/3 weapons came and started abusing and assaulting after slamming the informant down. When the informant's son came to rescue, the petitioner and the co-accused Jyoti Kumari caught hold of the informant's son and the co-accused Prakash Sharma started inflicting blows of Rukhani indiscriminately. When the local people and the informant's son Santosh Kumar came, all the accused persons fled away.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Learned counsel has further submitted that the specific allegation of assault is against the co-accused Prakash Sharma. Learned counsel has submitted that the petitioner is a lady. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 17.09.2022. Learned counsel for the Informant as well as learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, the petitioner being a lady as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the
