JUSTICE RAKESH KUMAR ORAL ORDER 07-12-2015 Heard Sri Madan Jeet Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. This is the second attempt for grant of bail on behalf of the petitioner. Earlier, the prayer for bail of the petitioner was rejected on 05.08.2015 vide Cr.Misc.No.28750 of 2015.The petitioner, who is husband of the complainant and is in custody since 20.04.2015 in connection with Complaint Case no.281 ( c ) of 2012 registered for the offence under Sections 498A and 379 of the Indian Penal Code, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that though the prayer for bail of the petitioner was earlier rejected on 05.08.2015, till date the evidence before charge is going on. He

Patna High Court Cr.Misc. No.52507 of 2015 (2) dt.07-12-2015 2/2 submits that the petitioner is in custody since 20.04.2015. Keeping in view the fact that even after rejection of earlier bail, no adequate progress has taken place as well as the fact that the petitioner is in custody since 20.04.2015, let the petitioner, namely, Sanjay Paswan be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bhojpur at Ara in connection with Complaint Case no.281 ( c ) of 2012.
