JUSTICE PRABHAT KUMAR JHA ORAL ORDER 09-01-2015 Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the State and learned counsel for the informant.

The petitioner, Om Nath Prasad, seeks regular bail in Gopalganj Mahila P.S. Case No.52 of 2014, registered under Sections 498A, 406/34 of the Indian Penal Code and under Section 3/4 of the Dowry Prohibition Act.

The wife made allegation that after six months of her marriage, her husband began to demand Rs. One lakh and subjected her to physical and mental torture. The wife gave birth to two children and she was pregnant, but her husband dropped her to her Naihar after snatching her belongings. Learned counsel for the petitioner submits that the petitioner never demanded any dowry. The wife is a quarrelsome

On the other hand learned counsel for the informant vehemently opposed the prayer for bail and submitted that reconciliation be held so that the marital relation be restored. It appears that the petitioner remained in jail since 17.11.2014.

Considering the fact that the petitioner has already remained in jail for about three months, his prayer for bail is allowed.

The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Mahila P.S.
