JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-01-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 341, 504 of the Indian Penal Code and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act. It is alleged that accused persons made protest against the sons and grand-son being nominated by the Durga Puja Samiti for being observing the Mela. On protest being made the accused persons came with sword, lathi and iron rod when co-accused Shrawan Vishwakarma caused injury with knife to the son of the informant Arvind Ravidas. Co-accused Tripurari Vishwakarma assaulted with sword to the grand-son of the informant. They also assaulted Yogendra Yadav, Rohit Ravidas with lathi. The accused persons also addressed the informant's side by calling caste name.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.1537 of 2016 (2) dt.12-01-2016 2/2 petitioner that specific overt act has not been alleged against the petitioner. The injury has been found to be simple in nature and there is counter version of the occurrence also. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Jamui in connection with Laxmipur P.S. Case No. 171 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
