The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 379, 323 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, on the alleged date and time of occurrence, all the FIR named accused persons including petitioner having variously armed came at the house of informant. Co-accused Ashok Ray and Vyas Ray misbehaved with the wife of informant and daughter-in-law. Thereafter, the accused persons started pelting stones. Co-accused Saran Kumar pointed country made pistol over the neck of informant. It is further alleged that all the accused persons snatched the

It is submitted that specific accusation of commission of assault and abuse is against other co-accused persons. No specific overt act has been alleged against this petitioner. Similarly situated co-accused have been granted anticipatory bail by this Court vide order dated 06.01.2023 passed in Cr. Misc. No. 62518 of 2022. Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Barh, Patna in connection with Athmalgola P.S. Case No. 108 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
