The petitioner being the husband of the victim is languishing in custody since 20.10.2013 in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

The accusation is of killing the daughter of the informant after 21 years of the marriage. It is submitted by learned counsel for the petitioner that the victim died natural death. During investigation the accusation was found true under Section 306 of the IPC, but differing with the final form the cognizance has also taken under Section 302 of the IPC when the informant has retracted from the

Patna High Court Cr.Misc. No.51713 of 2014 (02) dt.06-01-2015 2/2 initial version and filed a petition to that effect before the learned court below.

Considering the fact that the accusation was found true under Section 306 of the IPC during investigation, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge IIIrd, Muzaffarpur in connection with Sessions Trial No. 418 of 2014 arising out of Maniyari P.S. Case No. 50 of 2012. The learned trial court will be at liberty to cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions.
