JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-02-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Sahiyara P.S. Case No.24/2015 registered under Section 392 of the Indian Penal Code.

The accusation is that while the informant was on his way through his motorcycle bearing registration no. 14P-8457 and when he reached at village Pokharbhinda, three motorcycle borne miscreants intercepted him and on the point of pistol, snatched his motorcycle and fled away. It is alleged that when the informant inquired from local persons then some of the female members of the village informed him that the son of one Dinesh Singh was seen going towards the village Pokharbhinda along with others

Patna High Court Cr.Misc. No.53171 of 2015 (3) dt.15-02-2016 and further the informant claims to identify the accused persons. Learned counsel for the petitioner submits that the petitioner is not named in F.I.R. In course of investigation, one Chandan Kumar was apprehended by the police, who disclosed the name of the petitioner and some others showing him involved in the present case and thereafter the petitioner was apprehended by the police. It is further submitted that nothing has been recovered from the possession of the petitioner nor he was put on T.I.P. The petitioner is in custody since 05.05.2015. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sahiyara P.S. Case No. 24/2015. Out of two sureties, one surety must be close relative of the petitioner.
