JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Allegedly, in the morning of 08.04.2014 petitioner and two others committed gang rape with the informant but police after due investigation, found accusation true only against petitioner whereas untrue against co-accused Bablu Das and Satya Narayan Das. Furthermore, police found that prior to the alleged occurrence there was sweet relation between the petitioner and informant and on the alleged date of occurrence the informant had gone to meet petitioner herself. Moreover, doctor also did not find any sign of rape upon the informant.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named,

Patna High Court Cr.Misc. No.37389 of 2015 (3) dt.04-11-2015 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Darbhanga in connection with Darbhanga Mahila P.S.Case No. 35 of 2014.
