JUSTICE SHIVAJI PANDEY ORAL ORDER 30-06-2020 Heard learned counsel for the petitioner and learned counsel for the State through Virtual Court proceeding. In the present case, the petitioner is seeking bail in connection with Kopa P.S. Case No. 84 of 2019, registered for the offence punishable under Sections 147, 148, 149, 323, 324, 307, 302 and 504 of the Indian Penal Code.

As per FIR, when the informant was sitting at his cattle yard along with his son Sandesh Kumar Sharma, the accused persons came there and abused and assaulted the informant and his son. When his wife, daughter and others came to rescue, they have also been assaulted. Thereafter, the present petitioner along with others caught hold his son and Naushad, Shamsher and Ali Sher took out their daggers from their pocket and pierced the same in the stomach and back of the informant's

Patna High Court CR. MISC. No.8108 of 2020(4) dt.30-06-2020 2/2 son, as a result of which, he died. The post mortem report also shows altogether 13-14 injuries.

Counsel for the petitioner submits that the co-accused have been granted bail by the different Benches of this Court vide order dated 15.10.2019 passed in Cr. Misc. No. 61464 of 2019, vide order dated 25.10.2019 passed in Cr. Misc. No.61129 of 2019, vide order dated 04.12.2019 passed in Cr. Misc. No. 77815 of 2019 and vide order dated 10.12.2019 passed in Cr. Misc. No.80848 of 2019, but looking to the entire facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner for the present.

Accordingly, the prayer for bail is rejected for the present.
