JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-01-2015 Heard learned counsels for the petitioners and the State. The petitioners are languishing in custody since 30.5.2013 in a case registered for the offences punishable under Section 395 of the Indian Penal Code.
The accusation is of committing dacoity. Name of the petitioner sprang up in the confession of co accused. It is submitted by the learned counsel for the petitioners that there is no recovery from the petitioners nor the petitioners have been put on test identification parade. Though the petitioners are accused in three other cases but they are on bail in those cases. Statement to the above effect has been made in paragraph 3 of the petition. It is further submitted that other accused persons have been granted bail vide Cr. Misc. Nos. 27278, 28028 and 40538 of
Patna High Court Cr.Misc. No.530 of 2015 (2) dt.08-01-2015 2/2 2014 by this court.
Considering the aforesaid facts, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Motihari in connection with Motihari Mufassil P.S. Case No.104 of 2013.
The learned court below shall be at liberty to cancel the bail bonds of the petitioners in case the petitioners gets involved in serious offence or default without any reasonable cause on three consecutive occasions.
