Petitioner Shailendra Kumar Pandey seeks bail in Shastri Nagar P.S. Case No. 78 of 2013, registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code as well as Section 138 of the N.I. Act.
The informant made allegation that the petitioner took Rs. 15,00,000/- for expansion of his business but did not return the money. On demand, petitioner issued a cheque but the same was dishonoured.
Learned counsel for the petitioner submits that some dispute arose between the business transaction and petitioner is in jail since 30.04.2013. The petitioner has already remained in jail for one year and nine months.

Having considered the facts that the petitioner is said to have taken money for expansion of his business and on account of repayment, the petitioner handed over a cheque for repayment of money but the same was dishonoured and the fact that the petitioner has remained in jail for one year and nine months, petitioner Shailendra Kumar Pandey is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna, in connection with Shastri Nagar P.S.
