The petitioner seeks bail in a case for the offence registered under Sections 363 and 366/34 of the IPC. The prosecution story, in brief, is that on 12.10.2019 the sister of the informant, namely, Anchal Kumari, aged about 18 years, went Korha Block to obtain Caste Certificate etc., but she did not return home. In course of search, the informant came to know that all the accused persons including the petitioner with a conspiracy kidnapped the sister of the informant for the purpose of marriage.
It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since
Patna High Court CR. MISC. No.11739 of 2020(2) dt.28-02-2020 2/2 14.11.2019. The petitioner has got no criminal antecedent. He has falsely been implicated in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The victim has been recovered. There is no allegation of sexual or physical abused is alleged against the petitioner. On behalf of the State and informant, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Katihar, in connection with Korha P.S. Case No. 415 of 2019. (Sudhir Singh, J) U.K./- U T
