Petitioner is named in the first information report but it was co-accused Rocky Singh who shot fire on the deceased. So far the petitioner is concerned, it is only stated that he along with other FIR named accused instigated the main assailant to kill the informant's husband.

Petitioner does not have any criminal antecedent and is languishing in jail custody since 28.8.2015.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in Nawanagar (Basudeva O.P) P.S. Case no. 147/2015. shahid (Hemant Kumar Srivastava,J) U T
