Petitioner seeks bail in connection Banka P.S. Case no. 191 of 2020 registered for the offence punishable under section 392 of the Indian Penal Code.
Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the FIR, it would manifest that the informant has alleged that on 07.03.2020, he was going to his maternal grand mother along with his labour after purchasing three he-goats and when they reached near Nema Tarh Nahar at about 3 p.m., three young persons riding on Apache motorcycle stopped him and snatched Rs 36500/-, two mobiles, one big goat and his motorcycle on the point of pistol. Learned counsel further submits that the informant in the FIR
Patna High Court CR. MISC. No.19681 of 2021(2) dt.15-11-2021 2/2 has specifically alleged that he can identify the accused persons but despite being in custody since 14.4.2020 till date he has not been put on TI parade nor petitioner was apprehended at the spot nor any incriminating article has been recovered from his possession and charge sheet has been submitted. Learned APP vehemently opposed the prayer for bail. Considering the facts that charge sheet has been submitted and till date petitioner has not been put on TI Parade, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in Banka P.S. Case no. 191 of 2020.
