ANJANA MISHRA ORAL ORDER 20-01-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The present modification application has been filed in view of the fact that in order dated 08.10.2015, passed in Criminal Miscellaneous No. 29922 of 2015, the direction had been issued to the petitioner to deposit 25% of the total alleged amount within a period of three months from the date of receipt/production of a copy of the order dated 08.10.2015. However, in the said order, there was no specific direction as to where the said amount was to be deposited. Learned counsel for the petitioner submits that he is willing and ready to deposit the said amount in the Court below prior to his surrender and, therefore, the extension of time for surrender earlier granted vide order dated 08.10.2015, may be extended by another period of three weeks.
Patna High Court Cr.Misc. No.3300 of 2016 (2) dt.20-01-2016 2/2 Let the petitioner deposit the aforementioned amount in the Court below and, thereafter, the order for surrender shall be treated as three weeks. Accordingly, the modification application stands disposed of.
