2. The petitioner is in custody in connection with Dinara P.S. Case No. 334 of 2023 registered for an offence punishable under Sections 341, 323, 324, 504, 506 and 147 of the Indian Penal Code and later on 302 of the IPC was added.
3. As per allegation in the FIR, all the accused persons have brutally assaulted the informant and his family members.
4. Learned counsel for the petitioner submits petitioner has falsely been implicated in this case. He next submits that both the informant and petitioner are own brothers and there is land dispute between them. Petitioner has got clean
Patna High Court CR. MISC. No.12942 of 2024(2) dt.29-02-2024 2/2 antecedent as stated in para-3 of the petition and petitioner is in custody since 28.07.2023.
5. Learned APP for the State opposes the prayer for bail of the petitioner.
6. From perusal of the first information report and impugned order dated 10.01.2024, it appears that the offence under Sections 147, 341, 323, 324, 504 and 506 of the IPC are bailable but during course of investigation injured Shankar Singh died and later during the investigation Section 302 of the IPC was also added. From these circumstances, it appears that the petitioner is only order giver, considering which I am inclined to grant bail to the petitioner. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Ist Additional Sessions Judge, Rohtas at Sasaram in connection with Sessions Trial no. 844 of 2023 arising out of Dinara P.S.
