JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 11.10.2014 in a case registered for the offences punishable under Sections 376, 506 of the Indian Penal Code, 3 (i) (x) of S.C./S.T. (Prevention of Atrocities) Act and Section 4 of Protection of Children from Sexual Offences Act.

The statement of victim has been recorded under Section 164 of the Cr.P.C. in which she has nowhere stated about the story of rape and it appears from the first information report as well as statement of victim recorded under Section 164 of the Cr.P.C. that there was love affair between the petitioner and victim.

Patna High Court Cr.Misc. No.51808 of 2014 (2) dt.07-01-2015 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge, Patna in connection with POCSO Case No. 41 of 2014 arising out of Patna Kotwali P.S. Case No. 633 of 2014.
