JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-04-2025 Heard Mr. Ajay Kumar Singh, learned counsel appearing on behalf of the petitioner, Mr. Umeshanand Pandit, learned APP appearing on behalf of the State and Mr.Babu Nandan Prasad, learned counsel appearing on behalf of the informant/Opposite Party No. 2.

2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 70(1) and 3(5) of the B.N.S..

3. The prosecution story, in brief, is that on 04.10.2024, this petitioner took the victim to his house and thereafter, committed rape. It is further alleged that this petitioner kept the victim for two days and thereafter, also

Patna High Court CR. MISC. No.8248 of 2025(3) dt.30-04-2025 2/3 brought three other persons who also committed rape along with the informant and thereafter, ousted her on 5.10.2024 at 8 PM.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. The present F.I.R. has been lodged after inordinate delay of two days and there is no plausible explanation for the same. Petitioner and informant are covillagers and in order to grab the property of this petitioner, this false and concocted case has been lodged. As a matter of fact, the petitioner is 60 years old and living in a house in which 15 to 16 other persons are living and as such, it cannot be believed that the petitioner and other persons would commit such offence in the house. Petitioner claims clean antecedents.

5. On the other hand, learned A.P.P. for the State and leaned counsel for the informant have vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that it is a case of gang rape. Petitioner is named in the F.I.R. with specific accusation that taking advantage of the victim, who is suffering from mental disease, he, along with other accused persons, committed rape.
