The petitioner is apprehending his arrest in connection with POCSO Case No.10 of 2019, arising out of Dehri Town P.S. Case No.38 of 2019, registered for the offences punishable under Sections 341/323/504/354/34 of the Indian Penal Code and Section 8/12 of the POCSO Act.

Allegation against the petitioner and co-accused is of teasing the informant, a minor girl, when she was on the way to her house. The petitioner snatched her mobile phone. Submission is that the parties have entered into a compromise.

Considering the nature of allegation, in my view, this

Patna High Court CR. MISC. No.19625 of 2021(2) dt.26-11-2021 2/2 is not a fit case for anticipatory bail. Hence, the prayer for anticipatory bail is refused. However, in the event of surrender of the petitioner within two weeks, the prayer for regular bail shall be considered without being prejudiced by the order of this Court.
