The petitioner seeks bail in a case under Section 304B, 201/34 of the Indian Penal Code.
The prayer for bail of the petitioner was earlier rejected vide order dated 18.12.2014 passed in Cr. Misc. No. 28479 of 2014 with a direction to the learned trial court to conclude the trial within nine months.
It is submitted that only three witnesses have been examined.
It appears that the trial court has already sent a letter for extending the period for conclusion of the trial. Considering the nature of allegation made against the
Patna High Court Cr.Misc. No.53353 of 2015 (2) dt.16-12-2015 2/2 petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
The learned trial court is directed to expedite the trial and conclude the same within six months from the date of receipt of this order holding the trial on day to day basis. The Superintendent of Police, East Champaran, Motihari is also directed to produce all the prosecution witnesses of Sessions Trial No. 44 of 2015 so that the trial must be concluded within six months. If the trial is not concluded within six months, the petitioner may renew his prayer for bail.
Let a copy of this order be sent to Superintendent of Police, Motihari as well as learned Additional Sessions Judge-IX, East Champaran, Motihari.
