2. The petitioner apprehends his arrest in connection with Ujiyarpur P.S. Case No. 118 of 2017, instituted under Section 379 of the Indian Penal Code.
3. As per the prosecution case, on 07.07.2017, the informant's bike bearing registration number BR09M3308 was stolen in which he had kept two mobile phones and two ATM cards. An FIR was registered under Section 379 against the unknown persons. The allegation against the petitioner is that he has used his sim in the stolen mobile phone.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this

He further submits that the petitioner has no knowledge about the stolen mobile phone and when he got know about it he returned it to the co-accused. Petitioner has clean antecedent and he undertakes to co-operate in the investigation and trial.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount to the satisfaction of learned Sub- Divisional Judicial Magistrate, Dalsinghsarai, Samastipur in connection with Ujiyarpur P.S. Case No. 118 of 2017, subject to the conditions laid down in Section 482 (2) of the Bharatiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023. (Sunil Dutta Mishra, J) tusharika/- U T
