2. The petitioner seeks regular bail in connection with Jehanabad (Kalpa) P.S. Case No. 11122 of 2025 registered for the offence under Section(s) 25(1-B)(a), 26 and 35 of the Arms Act.

3. As per the prosecution case, two country-made pistols, fourteen cartridges, and cash amounting to Rs. 9,38,600/- were recovered from the house of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The petitioner has been in custody since 25.10.2025. It is further submitted that the petitioner has enmity with his own brother,

Patna High Court CR. MISC. No.9130 of 2026(4) dt.27-04-2026 2/3 namely Dharmendra Kumar, who allegedly threatened to implicate him in a false and fabricated case. In furtherance of the said conspiracy, it is contended that arms and ammunition were secretly planted in the petitioner's house, and thereafter the police was informed. It is also submitted that the petitioner and other family members had sold their ancestral land in their village and kept the money at the house for the purpose of purchasing land at Jehanabad, which amount has since been seized by the police.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the nature of allegations, the period of custody of the petitioner, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Jehanabad (Kalpa) P.S. Case No. 1122 of 2025 subject to conditions that:- (i). The petitioner will mark his attendance at the Jehanabad (Kalpa) Police

Patna High Court CR. MISC. No.9130 of 2026(4) dt.27-04-2026 3/3 Station on the first and third Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.

(ii) The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bond of the petitioner.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
